Terms and Policies
1. Acceptable Use Policy (“AUP”)
1.1 The Customer undertakes that it and its Authorised Users shall not:
(a) use the SaaS Service or any Application, other than for the Customer’s own internal purposes;
(b) copy, reproduce, publish, distribute, redistribute, broadcast, transmit, modify, adapt, edit, abstract, store, archive, display publicly or to third parties, sell, resell, license, lease, rent, assign, transfer, disclose (in each case whether or not for charge) or in any way commercially exploit any part of the SaaS Service or an Application;
(c) permit any use or access of the SaaS Service (or any Application) in any manner by any third party (including permitting use in connection with any timesharing or service bureau, outsourced or similar service to third parties or making the SaaS Service (or any part) available to any third party or allowing or permitting a third party to do any of the foregoing);
(d) combine, merge or otherwise permit any part of the SaaS Service (or any Application or interface) to become incorporated in any other program or service, or arranging or creating derivative works based on it (in whole or in part); or
(e) modify, make derivative works of, decompile, reverse engineer, disassemble, reproduce, republish, or copy the SaaS Services or any Application, unless required to be permitted by applicable law for interoperability, except as expressly permitted under the Agreement.
1.2 When using the SaaS Service the Customer shall not and shall ensure its Authorised Users do not:
(a) use the SaaS Services in a way that breaches applicable laws in the Customer’s jurisdiction, or promotes or condones hate, violence or discrimination;
(b) upload any information or materials which infringe on the Intellectual Property Rights of others;
(c) upload, post, disseminate or otherwise transmit any material or language that is abusive, obscene, pornographic, bullying, defamatory, harassing, grossly offensive, vulgar, threatening, or malicious, or that would encourage any conduct constituting a criminal offence or promote or incite violence;
(d) upload, post, disseminate or otherwise transmit any material that contains software viruses, harmful materials, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment including but not limited in relation to Customer use;
(e) promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals;
(f) interfere with or disrupt the SaaS Service or the website, or disobey any requirements, procedures or policies or regulations of networks connected to the website or associated with the SaaS Service;
(g) use the SaaS Services for any illegal or immoral purpose or in any way that might bring the reputation of JustGo or its service providers into disrepute;
(h) use the SaaS Services in any manner that could damage, disable, overburden, or impair any part of the SaaS Services or the network connected to any servers, or interfere with any other party’s use and enjoyment of any multi tenanted SaaS services offered by JustGo from time to time;
(i) impersonate other people, including resetting of passwords to gain access to Authorised User’s individual accounts;
(j) commit any criminal offence in relation to the SaaS Services and the SaaS Systems including attempting to gain unauthorised access to any part of the SaaS Services or Applications, other user accounts, computer systems or networks, though hacking, password mining, or any other means whatsoever;
(k) allow children and minors to access and use the SaaS Services unless the Customer is complying with applicable laws in relation to such use and obtaining the consent of parents or guardians to such use.
1.3 JustGo operates a fair usage policy across the SaaS Services and accordingly may need to prevent the Customer and its Authorised Users from excessive usage including email, text, and API call volumes. The Customer shall not use the SaaS Services for streaming videos or for unauthorised mass-communication such as SPAM or junk mail.
1.4 The Customer is responsible for administering usernames and passwords for Authorised Users and ensuring that all passwords and login details are kept strictly confidential. User names must not be shared by Authorised Users.
1.5 The Customer and Authorised Users shall adhere to “unsubscribe requests”.
